Federal Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without lawful basis.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her order.
The case stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to face alien smuggling allegations, he was detained in immigration custody.
In her decision, the judge noted that the authorities does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
Background of the Case
The legal proceedings involve conflicting assertions. Whereas the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing trial in the state of Tennessee.
Terms of Release
The court, who was overseeing his petition to removal in a federal court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This order shifts his supervision to the Tennessee court.
This decision represents a notable turn in a complicated immigration case featuring allegations of wrongful detention and disputed criminal associations.
